Abstract

Constitutional review is the mechanism used to ensure that laws and acts of public authorities comply with the Constitution. It is therefore essential to safeguard the supremacy of the Constitution within the legal system. However, there is a high rate of unconstitutional laws, especially at the state and municipal levels, which overloads the Federal Supreme Court and undermines legal certainty. The current model of repressive control proves to be costly and limited in terms of promptness, as it addresses normative issues only after the enactment of laws. In this context, Artificial Intelligence emerges as a promising tool for enhancing preventive constitutional review by enabling the early identification of normative inconsistencies. This study aims to present evidence on the use of intelligent legal systems to support decision-making in constitutional matters, exploring their potential to optimize legislative oversight and reduce the need for repressive interventions by the Judiciary. Furthermore, the paper identifies gaps in the literature and proposes guidelines for the implementation of technological solutions that promote greater efficiency and legal certainty in the country.
