Resumo

The rapid evolution of neurotechnologies necessitates urgent reflection on emerging ethical, legal, and social issues. This ongoing study seeks to contribute to the promotion of ethical innovation, effective governance, and equitable territorial development, with the defense of human rights as a fundamental pillar.

The central objective is to provide a robust framework for integrating the legal framework of neurorights, innovation, and governance, with a view to a sustainable territorial development model. In this context, technology companies are gaining prominence, thereby challenging the traditional boundaries between the state and private enterprise. Contemporary challenges are often multifaceted, requiring solutions that span the boundaries of a single field of knowledge. Neurotechnologies demand specific regulations to safeguard rights such as mental integrity and privacy, which are increasingly vulnerable to data exploitation. Moreover, the implementation of corporate governance and accountability instruments is essential. Given the innovative character of these technologies, it is vital to investigate the relationships between the various actors in innovation ecosystems. The present study is founded on the Sixfold Helix Theory of Innovation Actors, as proposed by Silvestre Labiak Junior.

The methodology employed consists of a comprehensive literature review and comparative studies of neurolaw regulatory frameworks.

The preliminary results of the study indicate that collaborative governance structures and public participation are essential for risk mitigation and the promotion of sustainable development.

The integration of neurorights, innovation, and governance is vital for sustainable development. Anticipatory governance and informed and participatory decision-making are mechanisms that promote social well-being and the protection of human rights.
